Terms and Conditions
By using the services on the website www.jacoapp.com, you accept the following conditions.
§1 Introduction 1.1 The website and the app are operated by JacoApp GmbH, UID: CHE-389.801.026, Am Stadtrand 56, 8600 Dübendorf, Switzerland (hereinafter referred to as “JacoApp”).
§2 Membership 2.1 Access to use the services offered by JacoApp requires the user to be a registered member of JacoApp. 2.2 Membership with JacoApp is established and valid through: a) The user’s agreement to the conditions and terms set by JacoApp; b) The correct input of user data (name, address, phone number, and email address) by the user in the JacoApp user profile, or by creating an account via their Facebook profile. The user can change or delete his user information at any time under the menu item “Account Settings”. By deleting all user information, which is a prerequisite for membership with JacoApp, the membership is automatically considered terminated. 2.3 JacoApp reserves the right to refuse or terminate any membership without prior notice. A user can cancel their membership at any time without notice under the menu item “Account Settings”.
§3 Marketing 3.1 Direct, indirect, or any other type of advertising by users through the JacoApp website is under no circumstances allowed. 3.2 Any action that violates §3.1 will be considered a serious violation of the agreement between JacoApp and the user. JacoApp reserves the right to remove any content on the website, and the right to take further legal action in case of a violation of §3.1. 3.3 If you refer JacoApp members to your own rental companies or refer JacoApp users to bookings outside of JacoApp, JacoApp reserves the right to charge a penalty fee of CHF 3,000.
§4 User Obligations 4.1 The user confirms that the data they provide is correct and that the transmission of this data to JacoApp does not violate any applicable law or infringe on the rights of third parties. 4.2 The user confirms that he or she will not introduce any indecent or punishable content through the use of JacoApp, such as viruses, programs, or software that can cause software or hardware damage to JacoApp or other users of the website. 4.3 The user confirms that they will not use private data on the JacoApp website, except for contact that is directly related to the provision of ride-sharing or rental services by JacoApp. The aforementioned misuse of private data primarily refers to the misuse of email addresses, private phone numbers, or addresses that the user may have obtained through the use of the JacoApp website. 4.4 The user confirms that he will use the JacoApp platform in accordance with the written guidelines in these terms and conditions. JacoApp reserves the right to evaluate the user’s correspondence with other users in case of suspected misuse. Furthermore, JacoApp reserves the right to terminate the user’s membership in the event of misuse of the platform.
§5 Disclaimer of JacoApp 5.1 JacoApp serves only as an intermediary, providing a communication platform and does not assume any further liability. The use of JacoApp’s communication platform for ride-sharing and/or rentals is therefore at the user’s own responsibility. JacoApp cannot be held financially liable for damages incurred in connection with a carpooling and/or the renting of vehicles. Similarly, JacoApp can in no case be financially liable for failed and/or partially failed carpools and/or rentals. 5.2 The user agrees and understands that JacoApp does not have control over the truth, accuracy, completeness, safety, timeliness, quality, legality or applicability of anything said or written by users or any services provided by users. JacoApp does not endorse any user-generated content and expressly disclaims any liability related to user-generated content. 5.3 JacoApp does not guarantee the confidentiality of communications between users.
§6 Data Protection 6.1 JacoApp collects, processes, and uses personal data of the user, as far as this is necessary for the establishment, content design or modification of the terms of use. 6.2 JacoApp will treat all data provided by the user as confidential in accordance with the relevant data protection laws. JacoApp does not pass on any user data to third parties, unless this is necessary for the fulfillment of the contractual relationship, or if the user has expressly consented to this.
§7 Intellectual Property 7.1 The JacoApp website, app, and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by JacoApp, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. 7.2 You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website, except as generally and ordinarily permitted through the Site according to these Terms and Conditions.
§8 Changes to the Terms and Conditions 8.1 JacoApp reserves the right to amend these terms and conditions at any time. 8.2 JacoApp will notify the user in due course about changes to the terms and conditions. The user is free to terminate his membership if they do not agree with the changes.
§9 Final Provisions 9.1 These terms and conditions and the entire legal relationship between the user and JacoApp shall be governed by Swiss law, excluding the conflict of law provisions and the United Nations Convention on Contracts for the International Sale of Goods. 9.2 The place of jurisdiction for all disputes arising from this contractual relationship is Zurich, Switzerland. 9.3 Should individual provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. 9.4 These Terms and Conditions were last updated on 25 May 2023.
